The Plea Chapter Thirty-Four – Broken

LoneCell

The Cheyenne Indian warrior featured in the book Mochi’s War was driven by the need to avenge the slaughter of her mother, father, and husband. The three were killed at the Sand Creek Massacre in November 1864. Mochi watched in horror as the people she loved were taken from her in the most violent way imaginable. It was easy to write about a woman who was horrified by what she saw and motivated to make the people that murdered her family pay. It is difficult to fight against anger; for a man will buy revenge with his soul. I’d never act on it, but I understand the fight.

There are no pictures of my brother after he was beaten and raped in prison. The photo that accompanies this entry is as close as I’ve come to what he looked like. This nightmare began for him with a false allegation of child molestation. I’ve been able to share Rick’s story with groups that I speak to about the books I’ve written. Since I can identify with Mochi’s overwhelming loss it seems fitting I share what was taken from my own life and how I can empathized with the broken woman.

BeatenFace

I am always amazed at the number of people who approach me after a lecture to share how often the allegation of child molestation is falsely made in the world today. It’s an epidemic and the PERFECT CRIME. The accused has to prove a negative and even when they are successful at doing so the courts are terrified to do anything about it. I’ve spent a dozen years studying this subject and have compiled a mountain of information.

False abuse accusations are equal opportunity exterminators. They can affect parents, old and young, teachers, a host of other professionals, and even children. Everyone is vulnerable. Nobody is exempt. These accusations can hit, anonymously, or via ex parte avenues, at any time, on any day. They work all day, every day…holidays included. And, when they hit, they do so like a hurricane, leaving a path of destruction that seems infinite.

According to respected child psychologist Doctor J. Petty and the Joint Custody Association of Los Angeles, there is a way for investigators to quickly determine whether or not the accusations are fake or factual.

Bona fide sexual abuse:

Mothers will generally be upset, secretive, and embarrassed.

In the case of my brother’s ex-wife, she was neither upset or secretive. The plan to make the false allegation was set in motion in April 2004 when she and her sister met with an attorney to find out if my brother could get full custody of their children in their likely divorce. My ex-sister-in-law was seeing another man at the time and no longer wanted to be with my brother. The allegation of sexual molestation was made on father’s day in June 2004. The entire family was in the car on the way home from church when the allegation was made.

The child will be fearful and timid in presence of abusing parent.

My brother’s step daughter wasn’t afraid at all. In fact, my brother was the fourth person she accused of abusing her. She was a seasoned vet by June 2004.

Description of abuse will be consistent.

Not only were the allegations made against my brother not consistent, but they were absurd. According to sworn testimony, the alleged victim claimed the sexual abuse only occurred between 6 a.m. and 6:15 a.m. when everyone was at home.

Fabricated sexual abuse:

Mother has a need to tell the whole world, expresses no shame.

Child also wants the whole world to know.

Child is comfortable in presence of the accused, and may even scream the accusations in the face of the accused parent.

Not only was my brother’s step daughter comfortable with him and screamed the accusations at him, but she told me in a recorded phone conversation I had with her in the summer of 2009 that she “missed her father” and thought he was a “great dad.”

Descriptions often have preposterous scenarios.

Not only were the allegations made against my brother not consistent, but they were absurd. According to sworn testimony, the alleged victim claimed the sexual abuse only occurred between 6 a.m. and 6:15 a.m. when everyone was at home.

Medical or SAFE exam contradict was accuser claims.

Read the medical exam for yourself. I’ve attached it to this entry.

MedicalProof1    MedicalProof2

March 3, 2016, will mark the twelfth year since my brother was falsely accused. It’s been hell. Rick’s life will expire in a concrete cell as the complications from Parkinson’s disease kills him. One thing that can be counted on…I’ll never forget how all this was set in motion.

There’s no need for revenge. I’m just going to sit back and wait. Those who caused this hurt will eventually screw up and if I’m lucky, God will let me watch.
